A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 9 (D) <br />FILE #1443 <br />WHEREAS, John C. Skoglund (hereinafter "the applicant") <br />is the owner of the property located at 1840 Fox Street within <br />the City of Orono (hereinafter "City") and legally described as <br />Lot 1, Block 1, Hi -Acres Two, Hennepin County, Minnesota <br />(hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.03, Subdivision 9 <br />(D) to permit the construction of a pool and pool house located <br />approximately 35' in front of the principal residence. The front <br />lot line of the property runs along the south lot line adjacent <br />to Fox Street. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1443. <br />2. The property is located in the RR-lB Single Family <br />Rural Residential Zoning District requiring 2 acres in area. <br />The property consists of 2+ acres. <br />3. The Orono Planning Commission reviewed this application <br />on September 6, 1989, and recommended approval of the <br />proposed variance based upon the following findings: <br />A) Access to the house is from the west. House was <br />designed as the west line as the front lot line. <br />B) Basic house and terrace decks were all located with <br />City approval of alignment and setbacks in 1983. The <br />pool is basically being reconstructed approximately in <br />the same location as the original one approved by the <br />City. <br />C ) To move the pool house to the west or the front of <br />the house would hinder the views from the front view <br />windows and detract from the character of the home. <br />Page 1 of 4 <br />
