A ABSOLUTION GRANTING <br />A LIMITED AFTER -THE -FACT VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISIONS 1 i 2 AND <br />SECTION 10.55, SUBDMSION 8 AND <br />A CONDITIONAL USE PERMIT PER <br />SECTION 10.03, SUBDIVISION 19 <br />PILE #1439 <br />WHEREAS, Lawrence <br />applicant") is the owner of the <br />Point Road within the City of <br />legally described as follows: <br />Langhans (hereinafter "the <br />property located at 1366 Rest <br />Orono (hereinafter "City") and <br />Lot 2, Block 1, Rest Point, Hennepin County, Minnesota <br />(hereinafter "the property") ; and <br />WHEREAS, the applicant has made application to the City <br />of Orono for after -the -fact approval of variances to Municipal <br />Zoning Code Section 10.22, Subdivisions 1 and 2, and Section <br />10.55, Subdivision 8, and a conditional use permit per Section <br />10.03, Subdivision 19, for the construction of retaining walls in <br />the 0-75' lakeshore setback zone where no structure or hardcover <br />is normally allowed, and further for the construction of a deck <br />located 10' from the lakeshore where no such structure is <br />normally allowed. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File 41439. <br />2. Thy property is located in the LR-lB Single Family <br />Lakesho�•. Residential Zoning District. <br />3. The 0:-ono Planning Commission reviewed this application <br />on August 21, 1989, and recommended on a vote of 5-0, <br />partial approval of the proposed after -the -fact variance and <br />conditional use permit, making the following findings and <br />recommendations: <br />Page 1 of 6 <br />
