(0 <br />N <br />PUBLIC PROTECTION <br />Sec. 5.16.030. General prohibitions. <br />(a) Tobacco use prohibited in certain areas. <br />Tobacco use is prohibited in the following areas: <br />(1) Parks; <br />(2) City facilities; <br />(3) Inside motor vehicles owned or operated <br />by the city; <br />(4) Inside motor vehicles at city facilities <br />and parks. <br />(b) Exceptions. Notwithstanding any other <br />provision to the contrary, the following areas are <br />exempt from the provisions of this chapter: <br />(1) Leases of city facilities or portions thereof <br />to non -city entities or individuals which <br />have been entered into before the adop- <br />tion of the ordinance from which this <br />chapter is derived; <br />(2) Designated outdoor areas of city facili- <br />ties; <br />(3) City streets, easements, and sidewalks <br />unless adjacent to or within parks; and <br />(4) City golf courses. <br />(Code 2003, § 51-3; Ord. Posting of signs and <br />removal of smoking <br />paraphernalia. <br />(a) "Tobacco -Free Grounds" signs shall be <br />clearly and conspicuously displayed outside every <br />city facility and park. <br />(b) All ashtrays and other smoking <br />paraphernalia shall be removed from every area <br />where tobacco use is prohibited under this chapter. <br />(Code 2003, § 51-4; Ord. No. 78(3rd series), § 1, <br />8-23-2010) <br />Sec. 5.16.050. Enforcement. <br />(a) Complaints. Any citizen who desires to <br />register a complaint under this chapter may <br />initiate enforcement with the city administrator <br />or his/her designee. <br />§ 5.20,110 <br />(b) Violation and penalty. It shall be a petty <br />misdemeanor for any person to use tobacco in an <br />area where tobacco use is prohibited by the <br />provisions of this chapter. The fine for violation <br />of this provision shall be $100.00 plus all <br />surcharges mandated by law. <br />(c) Other applicable laws. This chapter shall <br />not be interpreted or construed to permit tobacco <br />use where it is otherwise restricted by other <br />applicable laws. <br />(Code 2003, § 51-5; Ord. Definitions. <br />The following words, terms and phrases, when <br />used in this article, shall have the meanings <br />ascribed to them in this section, except where <br />the context clearly indicates a different meaning: <br />Commercial establishment means any premises <br />where a commercial or industrial enterprise of <br />any kind is carried on, and shall include <br />restaurants, clubs, churches, conference centers <br />and schools where food is prepared or served. <br />Multiple dwelling means any building used <br />for residential purposes consisting of more than <br />three dwelling units with individual kitchen <br />facilities for each. <br />Refuse means all organic material resulting <br />from the manufacture, preparation or serving of <br />food or food products, and spoiled, decayed or <br />waste foods from any source, bottles, cans, <br />glassware, paper or paper products, crockery, <br />ashes, rags, and discarded clothing, tree or lawn <br />clippings, leaves, weeds and other waste products, <br />except human waste or waste resulting from <br />building construction or demolition. <br />*State law references —Waste Management Act, Minn. <br />Stats. ch. 115A; littering, Minn.
