W) <br />ti <br />§ 3.08.360 <br />ORONO CODE <br />(4) Deposit or leave any paper, can, bottle, <br />glass or other refuse on or near a city <br />dock except in approved containers placed <br />by the city for such purpose. <br />(c) It is unlawful for any person to disobey <br />any order of a police or health officer relating to <br />the use of a city dock, or to disobey any sign - <br />posted regulation or rule. <br />(Code 1984, § 9.33; Code 2003, § 22-101) <br />Sec. 3.08.370. Off leash dog areas; permits <br />and regulations. <br />(a) Dogs may be unrestrained by chain or <br />leash in areas designated for off leash activities <br />by the city. No person shall use a designated off <br />leash area without first having obtained a permit <br />for each dog using such an area from the city. A <br />dog deemed a dangerous animal, or as a danger- <br />ous or potentially dangerous dog as defined <br />under Minn. Stats. § 347.50, is not permitted to <br />use off leash areas. <br />(b) The annual fee for an off leash area permit <br />shall be set city council and published in the <br />annual fee schedule. A permit may only be <br />issued upon verification of rabies vaccination. <br />Permits shall be valid from the time they are <br />issued until December 31 next after the date of <br />issuance. <br />(c) Upon application for a permit, the applicant <br />shall be provided with the rules for use of off <br />leash areas. As a condition for the issuance of a <br />permit, the applicant shall sign and agree to <br />abide by these rules. <br />(d) Feces clean up. Any person having the <br />custody or control of any dog or domestic animal <br />shall have the responsibility for cleaning up any <br />feces of the animal and disposing of such feces in <br />a sanitary manner. It shall furthermore be the <br />duty of any person having custody or control of <br />any dog or domestic animal on or about any <br />public place to have in such person's possession <br />suitable equipment for picking up, removal and <br />sanitary disposal of animal feces. Violations of <br />this provision may result in an administrative <br />fine. <br />(e) The person responsible for a dog must <br />have the dog restrained when entering and <br />leaving an off leash area. If so directed by a law <br />enforcement officer, animal care and control <br />officer, or animal warden, persons using an off <br />leash area must immediately restrain their dogs <br />and remove them from the off leash area. <br />(f) Enforcement. <br />(1) Compliance required. All persons shall <br />comply with the park signs and markers <br />installed by the city. <br />(2) Enforcement authority. Designated city <br />officials and law enforcement authorities <br />shall have the jurisdiction to enforce any <br />violation of these rules and any state or <br />local laws which occur on park property. <br />(3) Violation a misdemeanor. Any infraction <br />of a duly adopted park rule constitutes a <br />misdemeanor and is punishable by law <br />or through an administrative offense fee. <br />Fees are listed in the city fee schedule. <br />(4) Permit revocation. A permit may be <br />revoked for failure of the applicant, or <br />any person who takes the dog into an off <br />leash recreation area, to abide by these <br />rules, or for violation of any of the provi- <br />sions of this chapter or ordinances that <br />occur within an off leash area. <br />(Code 2003, § 22-02; Ord. No. 176(3rd series), <br />§ 2, 8-22-2016) <br />ARTICLE IV. SPECIAL REGULATIONS FOR <br />BIG ISLAND NATURE PARK <br />Sec. 3.08.410. Purpose. <br />(a) Through mutual collaboration between the <br />city and the Minnehaha Creek Watershed District, <br />Big Island Nature Park is intended to be <br />preserved, maintained and improved as a pas- <br />sive recreational, ecological and educational asset <br />to the Lake Minnetonka community and its <br />visitors. A conservation easement has been <br />established over the park property that restricts <br />the level of improvements and activities to ensure <br />these goals are accomplished. <br />CD3:34 <br />
