o <br />CORCLUSIOHS, ORDER AND CONDITIONS <br />Based upon one or more of the findings noted above, the <br />Orono City Council hereby grants approval of the above referenced <br />variances to permit the relocation and construction of a <br />commercial structure of 4,500 square feet at the property known <br />as Windward Marine, Inc., and in addition, grants approval of the <br />commercial site plan based on plans drawn by Rutledge <br />Construction, Job #J 8060, revised date 6/14/89, subject to the <br />following conditions: <br />1. Prior to issuing a building permit for the commercial <br />structure and/or issuing a demolition permit for the razing <br />of the existing structure, the following must be completed <br />by the applicant: <br />a) Approval by the City Engineer of final grading and <br />drainage plans for the relocated parking area. <br />b) Applicant shall submit a Developer’s Agreement <br />with a Tietter of Credit written at 150% of the cost of <br />the required improvements to ensure the completion of <br />the landscaping and site Improvements required by the <br />City as a result of the upgrading of this property. <br />2. All green-space areas to be planted or restored per sice <br />plan by Rutledge Construction, Inc., revised date 8/3/89 - <br />entitled "Drainage Plan". This area includes the 5* buffer <br />along the north and south lot lines adjacent to the <br />residential and commercial properties, the former boat <br />launch area in the southwest corner of the property. <br />3. Payment of two SAC units at $1,100.00 ($550.00 per <br />current unit charge) with the building permit for the <br />construction of the commercial structure. <br />4. The 4,500 square foot commercial structure must be <br />provided with an automatic sprinkler system per State <br />Building Code, Appendix E. <br />5. Appropriate soil erosion control program shall be <br />maintained through the entire project and until permanent <br />erosion control is in effect. <br />6. Applicant shall provide six "year-round” parking stalls <br />within the proposed parking area to ensure adequate customer <br />parking tpace during winter boat storage months. <br />o <br />Page 4 of 7
