FILE #LA25-000026 <br />21 July 2025 <br />Page 2 of 5 <br /> <br /> <br />Practical Difficulties Analysis <br />Applicant Submittal Information: The applicant has identified the large area of Ferndale Marsh as impacting <br />the developability of the property, with additional lake and wetland setbacks, as practical difficulties <br />supporting the requested variances. Additionally, they have provided supporting documentation regarding <br />Practical Difficulties attached as Exhibit C, and should be asked for additional testimony regarding the <br />application. <br /> <br />Planning Staff Practical Difficulty Analysis: Regarding practical difficulty, Staff finds the significant impact of <br />Ferndale Marsh from a setback and lake designation standpoint results in no legal buildable area. These <br />factors, combined with the location of the existing improvements, serve as practical difficulties generally <br />supporting the requested variances. <br /> <br />Due to the nonconforming conditions on the property, any change to the footprint of the decks resulting in <br />new footprint areas will require variances. The purpose of the proposed changes, to improve the functionality <br />of the deck areas, appears to be reasonable, and although minimal, Staff does not support the increase in <br />hardcover.
