Gaffron, Asst Planning & Zoning Administrator <br />Date: May 16, 1989 <br />Subject: Ordinance Amendment, Oversized Accessory Structures <br />Introduction ~ <br />In the spring of 1987, Council directed the Planning <br />Commission to review the accessory structures section of the <br />zoning code in relation to oversized accessory structures. The <br />initial review occurred at a public hearing held Monday, July 20, <br />1987. The public hearing notice indicated the review would be <br />for a proposed amendment to establish performance standards for <br />the location, floor area, and height of accessory structures <br />exceeding 1,000 square feet in floor area as a conditional ^se« <br />There were no public comments at the public hearing, and the <br />hearing was closed. <br />Further discussions by the Planning Commission were held on <br />December 1, 1987; February 25, 1988; May 18, 1988; July 6, 1988; <br />and May 1, 1989. Those discussions resulted in a recommended <br />ordinance amendment attached hereto as Exhibit A. <br />Discussion - <br />The Planning Commission concluded that a conditional use <br />permit is not the appropriate approach to oversized accessory <br />structures, and instead set up performance standards for <br />oversized accessory structures as a permitted accessory use^ The <br />following list sumarizes the Planning Commission recommended <br />ordinance revisions: <br />1. Defined "oversized accessory structure" as having a <br />footprint area greater than 1,040 square feet. <br />2. Allowed as a permitted use, one (1) oversized accessory <br />structure per property. <br />3. As lot size increases, the maximum allowed oversized <br />accessory structure size could increase. <br />4. Likewise, as lot size increases, the total combined <br />footprint area of all accessory structures on a property can <br />increase. <br />5. Excluded pools, tennis courts, paddocks, barns, stables <br />and greenhouses from being subject to the "size versus lot <br />area" requirement (also see #9 below).
