Option 6: Only apply the ALS when the <br />hardcover level exceeds the allowed limit. <br />• Application: <br />• The ALS would not apply to a lot with a conforming hardcover level (25%). The building limit <br />would be the shore setback requirement. <br />• For properties with nonconforming hardcover levels (over 25%), the additional ALS will be <br />applied. <br />• Analysis: <br />• Onerous. Applicants would be required to provide more information to determine the setbacks <br />on each property. <br />• Confusing for applicants. It is not an appropriate solution to address the identified challenges <br />with the ALS regulation. The ALS and hardcover limitations do not address the same concerns. <br />While both limit the development of a parcel, they do not have the same goal.
