This application was reviewed as Zoning File#04-3015. <br /> 2. The property is located in the LR-lA, Single Family Lakeshore <br /> Residential Zoning District, which requires a minimum lot area of 2 acres <br /> and a minimum lot width of 200'. <br /> 3. The Planning Commission reviewed this application at a public hearin� <br /> held on May 17, 2004 and recommended approval of the conditional use <br /> permit, the average lakeshore setback and side setback variances based on <br /> the following findings: <br /> a. The property has 43,713 s.f. (1.0 acre) in lot area and 140' of lot <br /> � width. <br /> b. No additional land is available for acquisition by the applicants to <br /> make the property conforming in azea or width. <br /> c. The property is served with m�uucipal sewer. <br /> d. The property is similar in size to many of the lots in this neighborhood. <br /> e. The applicants' initial proposal included a hardcover variance within <br /> the 75'-250' setback zone which the Planning Commission voted to <br /> recommend for denial and has since been revised to meet lot coverage <br /> and hardcover requirements. <br /> £ The average setback variance will have no impact on lake views <br /> enjoyed by the neighboring property owners. <br /> �. The side setback variance will allow revisions to roofline a the same <br /> setback as currently exists and will have no negative impacts on the <br /> open space or character of the neighborhood. <br /> 4. The City Council has considered this application including the findings <br /> and recommendation of the Planning Commission, reports by City staff, � <br /> � - comments by the applicant and the public, and the effect of the proposed <br /> variance on the health, safety and welfare of the community. <br /> Page 2 of 6 <br />
