Byars Jr. and Bonnibel S. Byars, husband and <br /> wife (hereinafter "the applicants") are the owners of the property located at 1389 Orono <br /> Lane within the City of Orono (hereinafter the "City") and legally described as follows: <br /> Lots 5 and 6,Homes on Brown's Bay,Hennepin County, Minnesota <br /> � (hereinafter the "property"); and ' <br /> WHEREAS, the applicants have made application to the City of Orono <br /> for a variance to Orono Mtuucipal Zoning Code Section 78-282 and 78-1285 to allow <br /> hardcover within the 75'-250' setback of 28.31% where 25% is normally allowed, and; <br /> WHEREAS, the applicants have made application to the City of Orono <br /> for a variance to Orono Municipal Zoning Code Section 78-305 Subdivision B to allow a <br /> side setback of 26.4' where 30' is required, and; <br /> WHEREAS, the applicants have made application to the City of Orono <br /> for a variance to Orono Municipal Zoning Code Section 78-1279 Subdivision 6 to allow <br /> an average lakeshore setback variance for a balcony and a roofline alteration including a <br /> "witch's hat"within the average lakeshore setback, and; <br /> WH�REAS, the applicants have made application to the City of Orono <br /> for a conditional use permit per Orono Municipal Zoning Code Section 73-966 and 78- <br /> 1250 in order to repair an ice ridje on the shoreline of the property and to construct a rain <br /> garden within 75' of Lake Minnetonka. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of <br /> Orono, Minnesota: <br /> • <br /> � PaJe 1 of 6 <br />
