' <br /> A RESOLUTION GRANTING A VARIANCE <br /> TO MUNICIPA.L ZONING CODE <br /> SECTION 78-282 A.ND 78-1288 AND <br /> A CONDITIONAL USE PERMIT IN ACCORDANCE <br /> WITH SECTION 78-418 (16) <br /> FILE NO. 04-3006 <br /> WHEREAS, Bartholomew Butzer and Elizabeth T. Butzer, husband and <br /> wife (hereinaf�er "the applicants") are the owners of the property located at 2625 North <br /> Shore Drive within the City of Orono (hereinafter the "City") and legally described as <br /> follows: � - <br /> Attached Exhibit A <br /> • (hereinafter the "property"); and <br /> WHEREAS, the applicants have made application to the City of Orono <br /> for a variance and conditional use permit to Orono Municipal Zoning Code Sections 78- <br /> 282, 78-1288 and Section 78-418 (16) to allow the existing detached garage to be <br /> replaced and relocated which requires a hardcover variance for the 75'-250' zone and a <br /> conditional use permit to allow phimbing within the new accessory building. <br /> NOW, T�IEREFORE BE IT RESOLVED by the City Council of <br /> Orono,Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File#04-3006. <br /> 2. The property is located in the LR— lA, One Family Lakeshore Residential <br /> District, which requires a minimum lot area of 2.0 acres. The applicant's <br /> property is 1.9'1 acres in total area. <br /> 3. The Planning Commission reviewed this application at a public hearing <br /> held on May 17, 2004 and recommended approval of the requested <br /> variance and conditional use permit based on the followin?findin�s: <br /> • . . <br /> .
