federal law or agreed to in writing by the City and the Developer. Thereafter, notwithstanding <br />anything in this Agreement to the contrary, to the full extent permitted by state law, the City may <br />require compliance with any amendments to the City's Comprehensive Plan, official controls, <br />platting or dedication requirements enacted after the date of this Agreement with respect to <br />property which did not receive final plat approval prior to any such amendment. <br />7.DEVELOPMENT PLANS. The Plat shall be developed in accordance with the <br />following plans (collectively, the "Plans"). The Plans shall not be attached to this Agreement. <br />The erosion control plan may also be approved by Minnehaha Creek Watershed District <br />MCWD). If the Plans vary from the terms of this Agreement, the terms of this Agreement shall <br />control. The Plans are: <br />Plan A-Plat <br />Plan B - Grading, Drainage, and Erosion Control Plan <br />Plan C -Landscape Plan(to include tree preservation and replacement) <br />Plan D - SWPPP Plan <br />Plan E - Final Storm Sewer plans and specifications. <br />8.IMPROVEMENTS. The Developer shall install and pay for the following as <br />required to be built in accordance with the approved Plans (the "Improvements"): <br />A. Site Grading and Erosion Control <br />B. Surveying and Staking <br />C. Private access and parking improvements <br />D. Stormwater Management Facilities <br />E. Landscaping requirements <br />235929v3
