SCANNED <br /> CITY of ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> k'ESIIDg� <br /> NO. t <br /> A RESOLUTION GRANTING VARIANCES TOj <br /> MUNICIPAL ZONING CODE SECTION 78-1112, <br /> AND A CONDITIONAL USE PERMIT <br /> PER SECTIONS 78-1113/14(2b) <br /> FILE NO. 04-2985 <br /> WHEREAS, Michelle A. Cullum and Thomas C. Cullum, Jr., husband and wife <br /> (hereinafter"the applicants")are owners of the property located at 785 Ferndale Road North within the <br /> City of Orono (hereinafter "the City") and legally described as follows: <br /> Tract B, Registered Land Survey No. 1031, Hennepin County, <br /> Minnesota, according to the files of the Registrar of Titles. <br /> (hereinafter "the property"); and <br /> WHEREAS, the applicants have submitted an application requesting a variance to <br /> Municipal Zoning Code Section 78-1112 and a conditional use permit per Sections 78-1113/14(2b)to <br /> permit filling and grading within and within 26'of a City-protected wetland where no such activity is <br /> normally allowed; and <br /> WHEREAS,after due published notice and mailed notice in accordance with Minnesota <br /> Statutes and the City of Orono Zoning and Planning Codes,the Orono Planning Commission held a public <br /> hearing on February 17,2004,at which time all persons desiring to be heard concerning this application <br /> were given the opportunity to speak thereon. <br /> NOW,THEREFORE,BE IT RESOLVED by the City Council of Orono,Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File#04-2985. <br /> 2. The property is located in the RR-1B Rural Residential Zoning District. <br /> Page 1 of 7 <br />
