4. The City Council has considered this application <br />including the findings and recommendations of the Planning <br />Commission, reports by staff and comments of the applicant and the <br />effect of the proposed use on the health, safety and welfare of the <br />community. <br />5. The City Council finds that granting a Conditional <br />Use Permit to allow a planned residential development will not be <br />detrimental to the health, safety and general welfare of the <br />public, would not adversely affect light, air nor pose a fire <br />hazard or other danger to neighboring properties, nor will it <br />depreciate surrounding property values and that the proposed level <br />of use of the property will be in keeping with the intent and <br />objectives of the Zoning Code and Comprehensive Plan of the City. <br />6. The City Council finds that the applicant has <br />proposed a planned residential development plan for development of <br />the property based on one or more of the following findings noted <br />by professional representatives of the applicant: <br />A. The topographical and physical characteristics <br />of the property suggest a need for special design <br />considerations. Variations in topography range from 1,044 <br />feet at its highest point to 994 feet at its lowest, <br />resulting in over 50 feet of grade differential. <br />B. On the site there are mature maple and other <br />deciduous trees. There is a densely populated forest of <br />maple trees in the west portion of the property and in the <br />-2-
