(b) Subdivider also agrees that it will <br />obtain the agreement of such other landowners as the City deems <br />necessary to petition for these improvements. <br />(c) Subdivider shall by executing this <br />agreement agree to the assessment formula, costs and payment terms <br />as set forth herein. <br />(d) Subdivider shall execute this <br />agreement and assessment appeal waiver prior to the time that the <br />public improvement project is scheduled to be ordered. <br />(e) Subdivider shall at the time this <br />agreement is executed, provide to the City all required assessment <br />payment bonds or other security as provided herein. <br />(2) General Procedures. Upon receipt of <br />Subdivider's petition and that of other required parties, the City <br />Council will order a feasibility report to be prepared by the City <br />Engineer. Upon receipt of said report, the City Council will call <br />an improvement hearing for the purpose of considering ordering of <br />these Plan B Improvements. Thereafter, the City Engineer will <br />prepare final plans and specifications and bids will oe taken. <br />Upon receipt of bids, the City Council will determine whether or <br />not to order any or all Plan B Improvements as a public project, or <br />to reject any or all bids and decline to order the public project <br />or any part thereof. Contracts will thereafter be awarded for any <br />Plan B Improvement to be constructed and installed as a public <br />improvement. <br />-8-
