<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br /> <br />NO. 7579 <br /> <br /> <br />1 <br /> <br />A RESOLUTION GRANTING <br />PRELIMINARY APPROVAL FOR A CIC PLAT, <br />CONDITIONAL USE PERMIT AND SITE PLAN APPROVAL <br />FOR THE GARAGE CONDO DEVELOPMENT <br /> <br />FILE NO. LA24-000068 <br /> <br />WHEREAS, Orono Garage Condos LLC, (hereinafter the “Developer”) on behalf of the <br />owners Old Crystal Bay LLC, (hereinafter the “Owners”) of the following property: 430 Old Crystal <br />Bay Rd, (PID 33-118-23-13-0016) legally described within Exhibit A (hereinafter collectively the <br />“Property”); <br /> <br /> WHEREAS on January 9, 2025, the Developer made a complete application for <br />Preliminary Plat, Conditional Use Permit and Site Plan approval to create a garage condo <br />development; and <br /> <br />WHEREAS, on February 18, 2025, after published and mailed notice in accordance with <br />Minnesota Statutes and the City Code, the Planning Commission held public hearings, at which <br />time all persons desiring to be heard concerning this application were allowed to speak thereon; <br />and <br /> <br />WHEREAS, on February 18, 2024, the Planning Commission tabled the application <br />provided guidance to the developer and regarding access, parking and landscaping changes; <br />and <br /> <br />WHEREAS, on March 17, 2025, the Planning Commission reviewed the revised <br />application. Although the Developer provided the requested information, the site plan did not <br />provide off-street parking on the site. The Commission was unsatisfied with the revised plans <br />which did not identify off- street parking, with a vote of 4-1, recommended denial of the <br />application as revised; and <br /> <br />WHEREAS, on March 27, 2025, the Developer submitted revised plans addressing <br />proof of parking identified with the site. <br /> <br />WHEREAS, on April 14, 2025, the City Council reviewed the revised application, the <br />recommendations of the Planning Commission and City staff, and made the following findings: <br /> <br />FINDINGS OF FACT: <br /> <br />A1.
