RESOLUTION NO. 596 <br />RESOLUTION DENYING APPLICATION <br />BY ARTHUR AHLM FOR BUILDING PERMIT <br />WHEREAS, Arthur Ahlm-has requested a building permit to <br />transform the existing house on Lot 4 and half of Lot 6, Block <br />6, Saga Hills into a garage and to build a new house attached <br />to the existing house on'that lot, and <br />WHEREAS, the lots are presently in an LR-1B.Use District <br />which requires minimum lot sizes of one acre and 140 feet in <br />lot width, and <br />WHEREAS, the lots do not meet the requirements of the <br />LR -1B Use District, and <br />WHEREAS, the present house therefore is a non -conforming <br />• <br />use, <br />NOW, THEREFORE, THE REQUESTED BUILDING PERMIT IS DENIED <br />FOR THE FOLLOWING REASONS: <br />1. The existing house is in a substandard lot and is <br />therefore a non -conforming use under Section 31.100 et. seq. <br />of the Zoning Code. <br />2. Section 31.100 et. seq. prohibits the expansion of <br />-pion-conforming uses when such an expansion will increase the <br />number of dwelling units or bulk of the building. <br />3. The applicant's plans show such a prohibited expansion. <br />4. There is no adequate access to the lot from the pub- <br />lic road. <br />5. To allow such an expansion would,be contrary to the <br />Zoning Code and the Comprehensive Plan of the City of Orono. <br />6.• Applicant's plans are a subterfuge to avoid the <br />requirements of the Zoning Code. <br />7. The existing structure is -patently not amenable to <br />transformation into a garage. <br />
