Zoning File #1326 <br />June 8, 1989 <br />Page 3 of 4 <br />Planning Commission Recomirendation - <br />At their May 15th meeting, some Planning Commission members <br />suggested that the driveway access location onto the private road <br />is unsafe, hence that may be the reasoning for the 2-4 vote on a <br />motion to approve the plat. One Planning Commissioner felt that <br />this proposal should not be allowed unless the private road is <br />upgraded, citing the City's reluctance in past similar situations <br />to force upgrading of private roadways as showing limited <br />foresight. Staff would not necessarily disagree with that <br />opinion, but would also note the extreme difficulties in <br />requiring multiple property owners to agree to granting road <br />dedications and upgr- ig private roads that pre-exist current <br />platting ordinances. <br />The Planning Commission also indicated that if Lauer and the <br />Country Club could come to an agreement with Hauser regarding <br />combining their proposed subdivisions, giving Lauer direct access <br />to North Ferndale Road through Hauser's property. Planning <br />Commission would consider that in a favorable light. The <br />applicants have not come to an agreement with Hauser, and at this <br />point each party wis es to proceed with their developments <br />separately. <br />The Planning Commission's second motion on May 15th was to <br />table. There being no second, the motion died. No further <br />motions were presented, hence the application is moved forward to <br />the City Council with somewhat clouded direction from the <br />Planning Commission. <br />Staff Recommendation - <br />The applicants have provided all information requested by <br />the Planning Commission, and have shown to the satisfaction of <br />the staff and the City Engineer that this development will have <br />no detrimental drainage impact on neighboring properties, and <br />should actually alleviate some of the existing drainage problems. <br />Additionally, applicant has stated his intent to disrupt as few <br />trees as possible in creating driveway access that is safe and <br />functional. Primary and alternate drainfield sites have been <br />tested and approved for mound systems. There are two variances <br />inherent in this proposal: <br />1. Lot width variance: <br />Proposed * 60' <br />Required * 200' <br />Variance * 140' <br />2. Variance for lack of frontage on a public roadway <br />variance is granted for virtually every new subdivision <br />the City served by a private roads).
