9. The City Council finds that the conditions existing on <br />this property are peculiar to it and do not apply generally <br />to other property in this zoning district; that granting the <br />variances would not adversely affect traffic conditions, <br />light, air nor pose a fire hazard or other danger to <br />neighboring property; would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate <br />a demonstrable hardship or difficulty; is necessary to <br />preserve a substantial property right of the applicant; and <br />would be in keeping with the spirit and intent of the Zoning <br />Code and Comprehensive Plan of the City. <br />10. The City Council finds that the expansion of the parking <br />area within the lakeshore protected area shall not be <br />detrimental to the health, safety or general welfare of the <br />public, would not adversely affect light, air nor pose a <br />fire hazard or other danger to neighboring properties, nor <br />will its use depreciate surrounding property values and that <br />the proposed level of use of the property will be in keeping <br />with the intent and objectives of the Zoning Code and <br />Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono <br />City Council hereby grants the variances and conditional use <br />permit as set forth above and approves tne commercial site plan <br />date revised __ _ _ _ _ _ _ _ by Sathre, Bergquist Inc. and attached <br />to this resolution as Page 8 of 8 for the Minnetonka Boat Works, <br />su bject to the following conditions: <br />1. Owner to execute a Developer’s Agreement and post a <br />Letter of Credit (150% of cost of required improvements) <br />with the City to ensure the following Improvements are <br />fulfilled upon the installation of the expanded parking area: <br />A) Drainage/surface water treatment improvements per <br />final plans approved by the M.C.W.D. and City of Orono. <br />The City Engineer has requested the following <br />amendments to the drainage plan: <br />i.
