A RBSOLUnON GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.55, SUBDIVISIONS 8 AND <br />SECTION 10.41, SUBDIVISION 10 (D) AND <br />PER SECTION 10.03, SUBDIVISION 19 <br />GRANTS A CONDITIONAL USB PERMIT AMD <br />PER SECTION 10.41, SUBDIVISION 2 <br />APPROVES THE COMMEROTJO. SITE PLAN <br />FOR MINNETONKA jlJAT WORKS <br />PILE #1396 <br />WHEREAS, Genroar Industries, Inc. (hereinafter "the <br />applicant") has an interest in the property located at 1449 <br />Shoreline Drive within the City of Orono (hereinafter "City") and <br />legally described as follows: <br />Exhibit A attached (hereinafter "the property"); and <br />WHEREAS, the applicant proposes the expansion of an <br />existing 42 stall parking lot by 26 additional stalls for a total <br />of 68 stalls to support a boat slip expansion of the commercial <br />marina of 48 slips for a total of 114 slips. Such improvement <br />requires approval of a conditional use permit for land <br />alterations in excess of 100 cubic yards and a variance to <br />Sect.ion 10.55, Subdivision 8 for land alterations conducted <br />within the 0-75* lakeshore protected area where none is allowed, <br />and per Section 10.41, Subdivision 10 (D) seeks approval of a <br />hardcover variance within the 0-75* setback area for an increase <br />of 2,219 square feet or 1.7% (total existing « 23,390 s.f. or <br />14.1%, total proposed » 25,609 s.f. or 15.48%) as a result of the <br />expanded parking area where no hardcover is allowed, and per <br />Section 10.41, Subdivision 2 seeks approval of a commercial site <br />plan for the expanded parking area within the eastern portion of <br />the marina property divided by Hennepin County Road 15. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1.
