LMCD Board 4/26/89 <br />5. Allow the police and sheriff to use the aiarina's docks at two <br />designated tie-on places, appropriately equipped and warked for police use only. <br />This space could also be available for public agency use. <br />6. Provide 6 to 0 (later amended to 8) aluminum fishing boats, half of them <br />motorized, if the City of Excelsior will so consent, or else provide an <br />alternative location for public <br />applicant's Maxwell Bay Marina. <br />fishing boat and motor rer^rls at <br />Currently there are 80 slips on the commercial property and 4 on the <br />residential property. At the request ofthe City of Excelsior the four docks <br />from the residential pro^‘*rt• will be assigned to the commercial property, with <br />any future owner of the residential property to be assured a free slip at the <br />marina. It was noted the commercial property has 810 feet of frontage and under <br />the code can support 81 slips. <br />The addition of leased shoreline from the City of Excelsior on Minnetonka <br />Boulevard allows the expansion of the DUA to accommodate a longer dock. There <br />was discussion regarding the zoning of the shoreline with Gilbert contending it <br />is public property and Kelly stating it is park property. <br />Frank Kelly, speaking for the City of Greenwood, discussed the <br />configuration of the dock, stating the current dock is a pier dock while the <br />proposed dock will be wider and longer, thus using more of the public waters of <br />St. Alban's Bay. He indicated no objection to rebuilding of the current dock in <br />the same location to correct any safety matters. He feels that by allowing the <br />lease of shoreline to create dock use area will create a problem for the <br />District in the future. <br />Tobermann <br />requirement. <br />offered to amend his application to 81 slips to meet the 1x10 <br />Alan Albrecht, Mayor, City of Greenwood, compared the dock size of the <br />current dock (50* x 440* « 22000 sq. ft.) with the proposed dock (80* x 550* » <br />44000 sq. ft.) thus doubling the size of the dock. <br />The LMCD Code as cited by the Executive Director, identifying the dock use <br />area in Sec. 2.01, Subd. 2(a) as _ _ the area for sites bordering on the lake, <br />extends into the lake a distance equal to the site Lake frontage to be measured <br />at right angles to the side site lines ....not extending into the Lake distance <br />greater than 100 feet .... which means the dock use area includes the distance <br />from the 929.4' shoreline to 100' into the Lake. <br />Before voting the following comments were aadc: <br />Rascop: The Shorewood City Attorney said LMCD cannot have a commercial <br />dock on public land, and he has been directed to vote against the proposal. <br />Grathwol: Excelsior will comment whin it comes before them, but this plan <br />is agreeable to them. <br />- continued
