Generally, fill not necessary for protection of <br />footings or directly related to house construction and exceeding an <br />amount of 100 cubic yards, requires a conditional use permit. <br />Pertinent Facts - <br />1. Amoun^ of fill brought in to date is approximately 4,500-5,000 <br />cubic yards. Applicant has continually graded the new fill as it is <br />delivered to the site, hence the filling has not been a general <br />neighborhood eyesore. <br />2. The applicant is the second or third owner of the property, and <br />has been attempting in the last few years to finish the house itaelf <br />in order to obtain the final Certificace of Occupancy. This house was <br />started in 1981 and the original builder apparently ran out of money, <br />hence when the current property owner purchased it, it was still <br />unfinished. <br />3. When the original building permit was issued, it was apparent <br />that fill was needed around the foundation and mound system area, as <br />well as the front yard, in order to protect the house from drainage <br />problems. However, the fill generally to the east of the driveway has <br />not been considered by staff as necessary to protect the house, <br />therefore a conditional use permit is required.
