Throughout this <br />time, both staff and Planning Commission have attempted to develop a repair <br />plan that would provide the least impact for the five involved property <br />owners. Staff has not included the many memos and extra exhibits submitted <br />for each of these reviews because they are no longer applicable. The most <br />recent memo of April 11, 1989 provides adequate background for Council's <br />consideration. Members are encouraged to contact either John Gerhardson or <br />Jeanne Mabusth if you seek additional information. Glenn Cook will be <br />present at the Council meeting. <br />Brief Review of Application - <br />The land use application itself involves the repair of minor portions <br />of Crystal Bay Road damaged in the storm of July 1987. The Public Works <br />Director has attempted to deal with the affected property owners for one <br />year prior to the filing date of the required conditional use <br />permit/variance application by the City. The land use application is <br />required because the land alterations are in excess of 100 cubic yards and <br />the roadbed is located within 75' of the lake. The road is not a platted <br />dedicated road but has been acquired through prescriptive easement over <br />approximately a 20' wide roadbed. <br />Amended Option 2, discussed in the attached memo, involves only four <br />of the original five property owners. The Schibilla property is no longer <br />included in the amended plan. A small portion of the Anderson property <br />will be included within the retaining wall intersecting the Schupp section <br />of the repairs (approximately 35 lineal feet of retaining wall). The <br />retaining wall involved within the Wolfe and Erger sections of the repair <br />will be approximately 125 lineal feet. The wall sections will be placed <br />just to the outside of the defined roadbed right-of-way. The 3' high <br />guardrail will be placed just to the outside of the retaining wall. Please <br />note the guardrail will only be installed along the portions of the <br />property involved with the repairs. As a result, the majority of the <br />Anderson property and the Schibilla property will not have the guardrails. <br />Please review the attached staff memo for detail on the guardrail <br />installation and the appropriate exhibits for the retaining wall (amended <br />Option 2, Exhibit G, is the recommended plan).
