Rossing (hereinafter "the applicant”) is the <br />o%mer of the property located at 130 Cygnet Place within the City of Orono <br />(hereinafter "City") and legally described as Lots 1 and 2, Bloc)c 3, Swan <br />Lake Addition, Hennepin County, Minnesota (hereinafter "the property")> and <br />NHBRBAS, the applicant has applied to the City for an after-the- <br />fact variance to Municipal Zoning Code Section 10.28, Subdivisions 5 (A) to <br />permit a deck reconstructed without the benefit of a building permit to <br />remain that is located 11*4" from the rear lot line instead of 50* as <br />required by the ordinance. <br />Minnesota: <br />HON, THBRBFORB, BB IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1387. <br />2. The property is located in the RR-IB Single Family Rural <br />Residential Zoning District requiring 2 acres in area. The property <br />consists of l-t* acres and was created prior to the current zoning <br />standards. <br />3. The Orono Planning Commission reviewed this application on March <br />20, 1989, and recommended approval of the after-the-fact variance <br />based upon the following findings: <br />A) Unusual shape of lot. <br />B) House located on lot prior to existing zoning standards. The <br />rear setbac! 3f the principal structure is 25* wherv«i the current <br />code requires a 50* setback. <br />C) Location of house on lot and interior floor plan restricts <br />construction or deck on east and south side of residence <br />structure . <br />Page 1 of 4
