Denial of B-1 rezoning application of Cliff Otten based on the <br />following findings: <br />A) Rezoning application is in complete conflict with intent of <br />Comprehensive Plan amendment for Highway 12. <br />B) The use is a mixed use requiring special zoning <br />consideration and would be more appropriately considered under <br />PUD zoning. <br />If formal denial action is taken by the Council, staff must be advised <br />to draft the appropriate resolution for formal action at your April <br />24, 1989 meeting. <br />2. Advise applicant to formally withdrawn current rezoning application <br />and direct staff to credit any fees that have not been expended for <br />this review against a new PUD application, and further direct <br />applicant to work with staff to resolve issues noted above prior to <br />the filing of a general concept stage of a PUD application. Council <br />may wish to advise applicant of their intentions regarding the B-6/PUD <br />ordinance presented for your review and action at this meeting. <br />3. To approve B~1 zoning application based on findings raised by <br />applicant.
