C) The proposed structural addition merely connects two existing <br />structures on the property, and follows the existing pattern of <br />development of structures on the property. <br />D) Drainage on the property should be reviewed by the City <br />Engineer. <br />4. The City Council has considered this application including the <br />findings and recommendations of the Planning Commission, reports by <br />City staff, comments by the applicants and the effect of the proposed <br />variance on the health, safety and welfare of the community. <br />5. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />property in this zoning district; that granting the variance would not <br />adversely affect traffic conditions, light, air nor pose a fire hazard <br />or other danger to neighboring property; would not merely serve as a <br />convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a <br />substantial property right of the applicant; and would be in keeping <br />with the spirit and intent of the Zoning Code and Comprehensive Plan <br />of the City. <br />CONCLUSIOHS, ORDER AND COHDITIONS <br />Based upon one or more of the findings noted above, the Orono <br />City Council hereby grants variances to Municipal Zon'*-"» Code Section <br />10.22, Subdivisions 1 & 2, and Section 10.55, Subdlvlslo to permit the <br />construction of a residential addition which comprises an ^ roachment past <br />the defined average lakeshore setback line and comprises new structure in <br />the 0-75* lakeshore zone where such structure is not normally allowed, and <br />to allow hardcover in the 0-75* zone of 21.9%, where no hardcover is <br />normally allowed, subject to the following conditions: <br />1. Applicant shall remove the long narrow storage hed in the 0-75* <br />lakeshore zone as noted on Exhibit B. Hardcover in the 0-75* zone <br />shall be limited to 21.9% as shown on Exhibit B. Any future requests <br />for additional hardcover in the 0-75* zone will not be approved. <br />Future hardcover requests in the 75-250* zone will be reviewed in <br />relation to the overall hardcover percentages normally allowed on the <br />property (i.e. hardcover existing in the 0-75* zone will be credited <br />in the 75-250* zone for calculation purposes). <br />?- Prior to filing of this resolution with Hennepin County and prior <br />to issuance of a building permit, the applicant shall provide a <br />grading and drainage plan for the property that meets with the <br />approval of the City Engineer. <br />Page 2 of 4
