a. The proposed walkway structure is necessary to <br />provide reasonable access to the usable lakeshore <br />without forcing the property owner to cross neighboring <br />property. <br />b. The structure will maintain a low profile and is not <br />intended to have a railing. <br />c. The 6* width, while 2' in excess of the 4* width <br />normally allowed for such structures, is necessary for <br />safety of the users of the structure, considering the <br />extremely long 175* length of this walkway. <br />d. The structure comprises 1.8% hardcover in the 0-75* <br />setback zone. There is no hardcover existing or <br />proposed in the 75-250* zone. The proposed walkway will <br />have no significant impact on runoff quantity or quality. <br />5. The City Council finds chat the conditions existing on <br />this property are peculiar to it and do not apply generally <br />to other property in this zoning district; that granting the <br />variance would not adversely affect traffic conditions, <br />light, air nor pose a fire hazard or other danger to <br />neighboring properties; would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate <br />a demonstrable hardship or difficulty; is necessary to <br />preserve a substantial property right of the applicant; and <br />would be in keeping w^th the spirit and intent of the Zoning <br />Code and Comprehensi^ ?lan of the City. <br />6. The City Council finds that granting a conditional use <br />permit to allow the construction of proposed walkway would <br />not be detrimental to the health, safety or general welfare <br />of the public, would not adversely affect light, air nor <br />pose a fire hazard or other danger to neighboring <br />properties, nor will it depreciate surrounding property <br />values and that the proposed level of use of the property <br />will be in keeping with the intent and objectives of the <br />Zoning Code and Comprehensive Plan of the City. <br />Page 2 of 5
