A RBSOLtJTION GRANTING <br />A VARIANCE TO HONICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISIONS 1 & 2, <br />AND SECTION 10.55, SUBDIVISION 8, <br />AND A CONDITIONAL USE PERMIT PER <br />SECTION 10.55, SUBDIVISION 10, <br />FILE #1364 <br />WHEREAS, Edwin Gage (hereinafter "the applicant") is <br />the owner of property at 480 Tonkawa Road located within the City <br />of Orono (hereinafter "City") and legally described as follows: <br />Tract A, RLS #1305, Hennepin County, Minnesota, <br />(hereinafter "property"), and <br />WHEREAS, the applicant has applied to the City of Orono <br />for a variance to Municipal Zoning Code Sections 10.22, <br />Subdivisions 1 and 2, and 10.55, Subdivision 8; and a Conditional <br />Use Permit per Municipal Zoning Code Section 10.55, Subdivision <br />10 to permit the construction of a 6* wide permanent walkway <br />through a designated wetland area, located less than 75* from the <br />shoreline where such structures are normally not allowed to <br />exceed 4* in width, and comprising hardcover in the 0-75’ setback <br />zone where hardcover is normally not allowed. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning Pile #1364. <br />2. The property is located in the LR-IB, Single <br />Family Lakeshore Residential Zoning District. <br />3. The property is approximately 5 acres in area. <br />4. The Orono Planning Commission reviewed this application <br />on January 17, 1989, and recommended on a vote of 4 to 3 to <br />approve the proposed variances and conditional use permit <br />for the 6* wide walkway structure based upon the following <br />findings: <br />Page 1 of 5
