Zoning Pile #1379 <br />February 16, 1989 <br />Page 2 of 2 <br />City Engineer Glenn Cook has reviewed the proposed pond construction <br />and notes that the pond will increase the water storage on the golf course <br />property. This would appear to be a benefit to the watershed. <br />The water area of this pond will be approximately 10,000 s.f. or about <br />Q.23 acres in area. The adjacent pond to the south is approximately 0.5 <br />acre in area. The existing pond was also man-made some years ago, and has <br />not been called out as a designated wetland on City maps, since the base <br />airphotos used for the designated wetland maps pre-date that pond's <br />construction. <br />With a total of approximately 3/4 acre in area. Planning Commisslor <br />should consider requiring the granting of a Conservation 6 Flowage F^asement <br />over these two ponds, which would be consistent with past City practice fox <br />ponds of this size. (The City has generally required a Conservation t <br />Flowage Easement for ponds of 1/4 acre and larger.) Since most ponds of <br />this nature are a benefit to the watershed, it would seem appropriate tc <br />protect them from detrimental changes. The property owner in this case <br />would be expected to provide a legal description for the Flowage £ <br />Conservation Easement. <br />Staff Eecoasmidation - <br />Staff recommends approval of the proposed pond construction, findinc <br />that the proposal meets the general standards for the issuance of i <br />conditional use permit per Municipal Zoning Code Section 10.03, Subdivisior <br />19 and 20. Staff would further recommend that the following conditions be <br />considered : <br />1. Spoils shall be placed at the applicant's normal fill site in the <br />City of Wayzata. If that site is not used and some site in Orono <br />proposed, the proposed fill site will need further review by the City <br />2. The property owner and his grading contractor shall take whatever <br />steps are necessary to insure that grading and excavation of this sit <br />does not adversely affect any other drainageways in the area due t( <br />erosion, etc. The disturbed areas shall be re-vegetated as soon a <br />possible. <br />3. The property owner shall provide a legal description and grant ^ <br />Conservation & Flowage Easement over the 1/4 acre pond to be create* <br />and the adjacent 1/2 acre pond. <br />4. The applicant is advised to contact the uinnehaha Creek Watershe> <br />District to obtain any permit they may require for construction o <br />this pond.
