RECYCLING AGR] <br />This agreement is entered into by and between Polka Dot <br />Recycling, Inc. of Buffalo, Minnesota (hereinafter "Contractor") and the <br />City of Orono, Hennepin County (hereinafter "City") to outline the rights <br />and obligations of the parties as they relate to the recycling of materials <br />within the City. <br />WHEREAS, for the consideration stated herein, the contracting <br />parties agree as follows; <br />1. Contractor agrees to pick-up recyclables. Including glass, metals, <br />newspaper, batteries, oil, corrugated cardboard and other materials as <br />the parties shall from time to time agree upon. <br />2. Contractor agrees that the pick-up shall be twice monthly and that <br />pick-up shall not be before 8:00 a.m. nor after 8:00 p.m. on those <br />stated pick-up days. Recyclables shall be plcked-up at the curbside <br />or where a private driveway intersects with a public or private road. <br />3. This contract shall be in effect from February 1, 1989 to January <br />31, 1990 unless otherwise cancelled by either of the parties as <br />outline in this agreement. <br />4. The City shall pay the Contractor $1,617.00 per month for the <br />services outlined in this agreement. It is understood that the <br />maximum amount during the contract term (February 1, 1989 through <br />January 31, 1990) shall be $19,410.00. <br />5. Contractor shall submit monthly reports of quantity and material <br />type to the City. Contractor shall also provide proof of sale and <br />weight slips to the City for materials collected under this agreement. <br />6. In the event Contractor misses a scheduled pick-up, he/she agrees <br />to make the missed collection on the day following by 7:00 p.m. <br />7. There shall be no collection on the following holidays: New Years <br />Day, Memorial Day, Independence Day, Labor Day, Thanksgiving and <br />Christmas. If collection day falls on one of the above holidays, <br />collection shall take place the following day. <br />8. Recyclable material shall be placed in containers provided by the <br />City or directly beside the containers if properly bound. Contractor <br />shall leave a violation notice with resident in the event recyclables <br />are not properly prepared for pick-up. Contractor agrees, however to <br />pick-up all recyclables unless violation by resident is frequent and <br />aggravated. In that case, the City shall be notified of the <br />offender's address and agrees to assist in correcting any violations <br />hereunder. <br />9. Contractor agrees that its employees shall do their best to remove <br />all recyclable materials and shall not leave spilled or dropped <br />recyclable material or other material at the curb side. <br />Page 1 of 2
