portion of their Property years ago has resulted in the <br />shoreline of Lake Minnetonka having been artificially modified <br />to create an inlet, the result of which is to deprive <br />Applicants of the ability to maintain any structure whatsoever <br />in their rear yard area. This situation also results in the <br />need for a variance from the applicable hardcover requirement <br />in as much as no hardcover whatsoever would otherwise be <br />permitted in Applicants’ rear yard area. <br />DESCRIPTION OF UNUSUAL PROPERTY CONDITIONS <br />Applicants’ lot is small and the house constructed thereon has <br />been placed so as to render the entire rear yard area within <br />the zero hardcover area and the 75-foot ”no structure” set-back <br />area. Applicants’ rear yard area is a bluff dropping down a <br />relatively sheer face at the rear to the shores of an inlet <br />dredged out to Lake Minnetonka. The surface of Applicants’ <br />rear yard is not visible from Lake Minnetonka. The existence <br />of a pool, or proposed decking surrounding a pool can not be <br />seen from Lake Minnetonka. <br />MISCELLANEOUS <br />Applicants have discussed with their neighbors, the Dunsheath <br />family, subdividing the Dunsheaths’ Property so as to permit <br />Applicants to acquire a portion of Tract D, Registered Land <br />Survey No. 420. This would vastly improve Applicants’ <br />hardcover ratio and would eliminate the need for the side yard <br />variance requested by Applicants. <br />REQUIRED SUBMITTALS <br />Attached to this Application is a certified ’Property Owners <br />List’ showing the owners within 150 feet of Applicants’ <br />Property. Also enclosed are ten stamped legal size envelopes <br />pre—addressed to each of the names shown on the <br />above—referenced ’Property Owners List’. Also attached is a <br />certificate of survey including hardcover calculations and a <br />copy of the Registered Land Survey. Finally, a description of <br />the proposed drainage improvements designed by Applicants <br />engineer is attached as are photographs taken by Applicants of <br />Applicants' rear yard area showing the relationship of <br />Applicants' home, pool and the shores of the inlet leading to <br />Lake Minnetonka. <br />- 4 -
