DESCRIPTION OF REQUEST <br />1. Applicants request a variance from the applicable 10-foot <br />side yard setback requirement to enable them to maintain a <br />pool ecjuipment shed which encroaches slightly upon the <br />property owned by their neighbors, the Dunsheath family. <br />When Applicants purchased the Property, the Dunsheaths <br />advised them that a refuse container structure owned and <br />used by the Dunsheaths encroached slightly upon <br />Applicants' Property and requested permission of <br />Applicants to maintain that structure. Applicants gave <br />their consent. Applicants later constructed the subject <br />pool equipment shed on Applicants' side of that <br />structure. When a survey of Applicants' Proper^:y was^ <br />later prepared. Applicants' discovered the true location <br />of the Property boundaries. Their neighbors had been in <br />error; the garbage container structure was completely on <br />the Dunsheaths' property, and the pool equipment structure <br />that Applicants had constructed encroached slightly upon <br />their neighbor's land. <br />2. Applicants request a variance from the 75-foot setback <br />requirement to permit Applicants to maintain a swimming <br />pool constructed by Applicants earlier this summer. <br />Prior to the construction of the subject swimming pool. <br />Applicants were unaware of the 75-foot set-back <br />requirement from the shores of Lake Minnetonka. Some <br />years ago, a portion of Applicants' Property was dredged <br />to create an inlet from Lake Minnetonka. This has <br />resulted in the rear yard portion of Applicants' Property <br />being reduced in size. <br />The pool constructed on the Property is situated on a <br />bluff in the rear yard area, and is not visible from the <br />lake. There is no portion of Applicants' Property more <br />than 75 feet from the shores of Lake Minnetonka upon which <br />a pool could have been constructed. Applicants are <br />willing to provide such landscaping as may be required by <br />the City to provide additional screening of the pool area. <br />3. Applicants request a variance from the applicable <br />hardcover requirements. <br />Applicants desire to construct decking around the existing <br />pool area in accordance with the plans attached to this <br />Application. Because of the size of Applicants' lot, any <br />such decking within the rear yard area would fall within <br />the zero hard cover area. <br />- 2 -
