CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />N0.7488 <br />A RESOLUTION <br />APPROVING A PRELEVIINARY PLAT FOR <br />THE PROPERTIES LOCATED AT <br />4375 AND 4246 BAYSIDE ROAD <br />FILE NO. LA24-000028 <br />WHEREAS, Steve White, (hereinafter the "Applicant") has requested approval of a <br />subdivision of the property addressed 4375 and 4246 Bayside Road within the City of Orono <br />(hereinafter the "City") also identified as PID's 06-117-23-12-0009 and 06-117-23-11-0003 and <br />legally described as shown in Exhibit A: <br />WHEREAS, on May 21, 2024, an application was filed with the City for preliminary <br />approval of a 3-lot residential plat of the Property; and <br />WHEREAS, after due published and mailed notice in accordance with Minnesota <br />Statutes 462.358 et. seq. and the City of Orono Zoning and Subdivision Codes, on June 17, 2024, <br />the Orono Planning Commission held a public hearing for the application at which time all persons <br />desiring to be heard concerning the application were given the opportunity to speak thereon; and <br />WHEREAS, on June 17, 2024 the Planning Commission reviewed the application <br />and recommended by a vote of 7 to 0 that the City Council grant preliminary plat approval; and <br />WHEREAS, the City Council reviewed the proposal at a regular meeting held on <br />July 8, 2024, and hereby makes the following findings with regards to this application: <br />FINDINGS <br />1. This application was reviewed as Zoning File LA24-000028. <br />2. The Property is guided in the 2040 Orono Community Management Plan (CMP) for <br />single family residential use, specified as Rural Residential (1 unit per 2 acres) and Rural <br />Preserve (1 unit per 5 acres). The proposed development with single family homes is <br />consistent with the provisions of the CMP, and is consistent with surrounding <br />development. The Property is not located within the MUSA and will be served by septic <br />and private water. <br />3. The Properties are zoned RR-lA One Family Rural Residential District (5.0 acres) north <br />of Bayside Road. South of Bayside Road, the zoning is split between RR-1B One Family <br />74 <br />
