CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 7562 <br />A RESOLUTION <br />APPROVING A VARIANCE FROM <br />MUNICIPAL ZONING CODE <br />SECTION 78-1279 <br />FILE NO. LA24-000067 <br />WHEREAS, on December 10, 2024, Northstar Renovations LLC ("Applicant"), <br />applied for a variance from the City Code for the property addressed 2691 Ethel Avenue and legally <br />described as: <br />Tract C, Registered Land Survey No. 115, Hennepin County, Minnesota, except <br />that part thereof lying Southeasterly of a line drawn from a point on the Southwesterly line <br />of said tract distant 15 feet Northwesterly from the most Southerly corner of said tract, <br />through the Northeasterly corner of said tract. Together with an easement for right of way <br />for road purposes over that part of Block 5, Winship's Subdivision of Lot Number One (1 <br />), Spring Park, 2nd Division, lying Southwesterly of the premises above described and <br />between the Northerly extension of the Easterly line and the Westerly line of Ethel Avenue <br />(now Tract E, Registered Land Survey No. 115) and also together with the right to use of <br />shore for private bathing and dock in front of a strip of land 15 feet in width, lying <br />Southeasterly of and immediately adjacent to the Southeasterly line of the premises <br />hereinabove first described, and which 15 foot strip runs Northeasterly along the <br />Southeasterly line of said premises from the Easterly extension of the Southwesterly line <br />of said premises to the shore of Carmen's Bay Lake Minnetonka; (now Tract B, Registered <br />Land Survey No. 115), Hennepin County, Minnesota (hereinafter the "Property"); <br />WHEREAS, the Applicant has made application to the City of Orono for a setback <br />variance from Orono Municipal Zoning Code Section 78-1279 to replace a deck within the average <br />lakeshore setback with minor footprint expansions; and <br />WHEREAS, on February 18, 2025, after published and mailed notice in accordance <br />with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at <br />which time all persons desiring to be heard concerning this application were given the opportunity <br />to speak thereon; and <br />WHEREAS, on February 18, 2025, the Planning Commission voted 7 to 0 in favor <br />of a motion to recommend approval of the variance as recommended by staff; and <br />WHEREAS, on March 10, 2025, the City Council reviewed the application and the <br />recommendations of the Planning Commission and City staff; and <br />156 <br />
