No additional land is available for acquisition by the applicants to ' <br /> make the property conforming in area or width. <br /> c. The applicants are proposing to construct an attached garage and 2"a <br /> story addition; no additional living space is proposed within the <br /> existing substandard setbacks. <br /> d. There is no available land to purchase to make the existing side yard, <br /> lake yard, and average lakeshore setbacks or hardcover levels <br /> conforming. <br /> e. The applicants' are proposing to remove portions of nonconforming <br /> hardcover within each zone in conjunction with this project. <br /> � 4. The Ci Council has considered this application including the findings <br /> t3' . <br /> and recommendation of the Planning Commission, reports by City staff, ' <br /> comments by the applicants and the public, and the effect of the proposed <br /> variance on the health, safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on this property are <br /> peculiar to it and do not apply generally to other property in t11is zoning <br /> district; that granting the variance would not adversely affect traffic <br /> conditions, light, air nor pose a fire hazard or other danger to neighboring <br /> property; would not merely serve as a convenience to the applicants, but is <br /> necessary to alleviate a demonstrable hardship or difficulty; is necessary to <br /> preserve a substantial property right of the applicants; and would be in <br /> keeping with the spirit and intent of the Zoning Code and Comprehensive <br /> Plan of the City. <br /> CONCLYJSIONS, O1�ER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants a variance to Orono Municipal Zoning Code Section 78-1288 to allow 16% <br /> hardcover within the 0-75' zone where 0% is normally allowed and 17% cunently exists; <br /> and 43.5% hardcover within the 75'-250' zone where 25% is normally allowed and <br /> � 54.6% currently exists; and 45% hardcover within the 250'-500' zone where 30% is <br /> normally allowed and 57% currently exists in conjunction with construction of an <br /> attached garage and 2"d story over the existing home, subject to the following conditions: <br /> Page 2 of 5 . <br />
