OS-3123 <br /> WHEREAS, Michael G. Hart and Kristin J. Hart, husband and wife <br /> " (hereinafter"the applicants") are the owners of the property located at 1005 Linden Lane <br /> witlun the City of Orono (hereinafter the"City") and legally described as follows: <br /> Par 1: Lot 1,"Linden Beach", and <br /> Par 2: The North 16 feet of that part of Lot 14, "Linden Beach", lying West of the following <br /> described line, drawn from a point on the South line of Lot 10 said Addition distant 84 feet East <br /> along said South line from the Southwest corner of said Lot 10 to the North line of Lot 14, <br /> "Linden Beach",passing through a point on the South line of Lot 13,"Linden Beach",distant 185 <br /> feet East of the Southwest corner thereof; All that part of the Northeasterly one-half of Linden <br /> • Lane vacated, lying between an extension Westerly of the Nortli line of Lot 14, "Linden Beach" <br /> and a line drawn parallel to and distant 16 feet South of said North line of Lot 14, and its <br /> extension,"Linden Beach",Hennepin County,Muinesota(hereinafter the"property");and <br /> WHEREAS, the applicants have made application to the City of Orono <br /> for a variance to Orono Municipal Zoning Code Section 78-1288 to allow 16%hardcover <br /> within the 0-75' zone where 0% is�normally allowed and 17% currently exists; and <br /> 43.5% hardcover within the 75'-250' zone where 25% is normally allowed and 54.6% <br /> currently exists; and 45% hardcover within the 250'-500' zone where 30% is normally , <br /> allowed and 57% currently exists. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of <br /> Orono,Minnesota: � <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File OS-3123. <br /> 2. The property is located in the LR— 1B One Family Lakeshore Residential <br /> Zoning District wluch requires a minimum lot area of 1.0 acre and a <br /> minimum lot width of 140'. <br /> 3. The Planning Commission reviewed this application at a public hearing <br /> �% �` held on June 20, 2005 and recommended approval of variances based on <br /> the following findings: <br /> a. The applicants' property has 14,017 s.f. or 0.32 acre in area and 64' <br /> width at the shoreline and 67' at the 75' setback. <br /> Page 1 of 5 . <br />
