D � � �, . � . <br /> kESI3� <br /> A RESOLUTION GR.ANTING . <br /> PRELTMINARY APPROVAL OF A <br /> CLASS III SUBDIVISION FOR <br /> PROPERTY LOCATED AT <br /> 801 TONKAWA ROAD <br /> FILE NO. OS-3073 <br /> WHEREAS, David R. Pomije and Joaiin Pomije (hereinafter the "subdividers") <br /> on December 20, 2004, filed a formal subdivision application with the City for approval <br /> of a two lot residential plat of property legally described as: <br /> � Lot 1, Auditor's Subdivision No. 217, Hennepin County,Minnesota <br /> • (hereinafter"the property"); and <br /> WHEREAS, after due published and mailed notice in accordance with Minnesota <br /> Statutes 462.358 et. seq. and the City of Orono's Zoning and Subdivision Codes, the <br /> Orono Plaruling Commission held a public hearing on April 18, 2005, at which time all <br /> persons desiring to be heard concerning this application were given the opportunity to <br /> speak thereon; and <br /> WHEREAS, at their regular meeting held on May 9, 2005, the Orono City <br /> Council considered the subdivision application of the subdivider noting the following <br /> findings of fact: <br /> 1. The property is located within the LR — 1B One Family Lakeshore <br /> Residential Zoning District requiring a minimum of 1 acre of contiguous � <br /> dry buildable land within each newly created lot. <br /> 2. The property contains a total of approximately 3.55 acres of land. There <br /> are no wetlands on the property. <br /> 3. The proposed plat consists of two residential lots each meeting the <br /> minimum lot standard requirements of the LR — 1 B, One Family <br /> Lakeshore Residential Zoning District, each meeting the minimum 1.0 <br /> • acre lot area requirements and each having over 140' in defined width at <br /> the shoreline and 75' setback. <br /> Page 1 of 5 <br />
