LMCCC Minutes <br />Page Four <br />NazarowWatts asked why the homes passed had dropped to 10,557. <br />said It was an error, and he would correct it. <br />Anderson asked Nazarow to address the outage of September <br />28. Nazarow explained that approximately 140 customers called to <br />ask what the problem was, and that all these calls were docu~ <br />mented. Nazarow said that on page 22 of the franchise agree <br />ment, it stated that planned interruptions should occur during <br />times of minimum use of service and that subscribers shall be <br />gxven reasonable notice of that interruption. <br />He then quoted from the September letter to subscribers which <br />stated it would be necessary to change the channel line-up and <br />that information would be available on Channel 19. In addition, <br />the message ran through the month ot September on channel 8, <br />telling subscribers of a possible interruption of service due to <br />the rebuilding/replacement of old cable with fiber optic. The <br />message also gave the phone number to call for assistance. <br />Nazarow stated that he felt Triax had given the subscribers suf <br />ficient information for 30 days prior to the switch. He then <br />referred again to the franchise agreement which states that if <br />service is interrupted for more than 48 hours, subscribers shall <br />be credited for such interruptions. <br />He went on to say that in actuality, there was no credit due <br />because the outage was not in excess of 40 hours, but he had of <br />fered to credit the accounts of those customers who called. The <br />credits would be pro-rated. <br />Wilczek stated that he felt the notice on Channels 8 and 19 <br />were not sufficient as they were not specific as to day and <br />time. Nazarow stated that it was not their plan to make the <br />swxtch in the late afternoon on a Friday. Coordination of staff <br />and equipment was difficult, he said, and he thought the switch <br />went smoothly, all things considered. <br />Watts asked when they would typically do this type of a switch <br />in a system. Wimler replied any day in the ..lorning during a nor <br />mal week. He then stated that he had been stuck in the office <br />on an emergency problem all day instead of in the field super <br />vising the switch. Watts asked how many subscribers were served <br />by the headend in Excelsior and affected by the outage. Wimler <br />said he didn't have the number of subscribers served by the <br />Excelsior head-end, but if affected the communities of Excel <br />sior, Shorewood, Greenwood, Deephaven, Woodland, and Victoria. <br />Anderson asked about the difficulty in reception after cho <br />switch. Wimler replied that there was a bad amplifier that had <br />to be replaced and overheating of another piece of equipment. <br />Wright said that he was still surprised that they went ahead <br />with the switch on a Friday afternoon. He went on to say that <br />he felt it was blatantly unfair that rebates woult only be given <br />to those who called; that there were people who didn't or <br />couldn't call and suffered the same outages, and they should all <br />be given a rebate. <br />Olds asked how much the rebate would be. Nazarow stated that <br />it would be based on the number of hours that service was out
