I- <br />LMCD Board of Directors October 24. 19.90 <br />Water Variances, which does not specify a requirement for the use <br />of seasonal dockaee. Particular concern was pointed out for dock <br />extensions creating winter lake use hazards from deicing, <br />particularly in the case of one 600’ extension granted. It was <br />also noted that a 200’ dock length normally is deiced some <br />distance beyond the dock length as a buffer between the ice and <br />dock. The Executive Director and Water Patrol concurred that a <br />conscientious inspection program can assure a reasonable deicing <br />activity is maintained. Foster moved, CJrathwoI seconded. to <br />amend the motion by deleting the 20U’ deicing restriction. <br />Motion carried unanimously. <br />The motion as amended was approved unanimously. <br />d) Windward Marine New Building Construction. Mark <br />Bernhardson, Orono City Manager, responding to the staff report, <br />advised the building under construction at Windward Marina was <br />approved in 1987 based on the removal of a sheet metal building <br />and old sales/service buildings. Time extensions have been given <br />to the variance. The existing sales/service building will now be <br />torn down. Responding to a comment from Reese about whether the <br />old building was non-conforming, Bernhardson respoin.led it was a <br />case of best possible improvement. Cochran said he is assuming <br />the Minnehaha Creek Watershed District has given approval to the <br />.Ntorm water run-off weir. No action was taken. <br />7. A. :3) LAKE USE COMMITTEE. Chair FiUsbury <br />a) Approval of Minutes Piilsbury moved, Babcock <br />seconded, approval of the minutes of lU-lb-9U as submitted. <br />Motion carried unanimously. <br />b) Code Amendment <br />Removal. Piilsbury moved, <br />to 2.12. Subd. 7, Regarding Buoy <br />Babcock seconded, to approve an <br />amendment to Code 2.12, Subd. 7 and Code 2.08, Subd. 3 per the <br />draft dated 10-10-90, publication authorized and amendment to <br />become effective upon early publication due to closeness to dates <br />of compliance. Motion carried unanimously. <br />c) Proposed Minnesota Department of Natural Resources <br />Bill for an Act Regulating Personal Watercraft <br />The committee received a recommendation from the Lake Use <br />Committee that the LMCD support the proposed DNR bill regulating <br />personal watercraft. Foster called the Board’s attention to the <br />provision in the bill requiring a 5 mph speed when the personal <br />watercraft is within 150’ of another watercraft. Foster^, views <br />this is highly dangerous in narrow areas of the lake. <br />Piilsbury moved. Rascop seconded, to support the MN DNR <br />efforts in establishing a state law regulating personal <br />watercraft and referring the portion of the bill limiting the <br />speed to 5 mph within 150’ of another moving watercraft to the <br />sub committee studying personal watercraft. Motion carried <br />unanimously.
