Zoning File #1473 <br />December 6# 1990 <br />Page 2 <br />Status of Application - <br />At the July 2 3, 1 9 90 meeting of the Council, Members <br />conceptually . .nied tne after-the-fact variance as proposed and <br />directed staff to prepare a denial resolution for future action. <br />At the Council meeting on August 13, 1990, staff asked that all <br />pending action on the application be delayed until staff had <br />adequate time to review the hardcover discrepancies that arose in <br />the latter part of the review. Applicant had contended a 10% <br />reduction was always proposed and staff's calculations resulted <br />with merely a 5% reduction (review Exhibits G and H). <br />On October 3rd, staff met with Mr, Johnson to review the <br />hardcover information prepared by staff (review exhibit F). At <br />that time Mr. Johnson was advised to have his surveyor review the <br />hardcover calculations of the bituminous drive within the 75-250' <br />setback area and to consider any other additional removals of <br />hardcover. The s<"aff sketch of existing hardcover (Exhibt F) was <br />accepted by Johnson subject to any new findings of surveyor. <br />The applicant' surveyor has submit a revised survey (refer <br />to Exhibits C and J). The driveway area within the 75-250' <br />setback area was originally determined at 2,272.25 s.f. The <br />revised calculation is at 2,350 s.f. (refer to Exhibit D). <br />Applicant also advises that 372 s.f. of landscape area existed on <br />the property prior to any deck construction. This has been <br />included in the revised hardcover calculations. Staff cannot <br />recall whether the landscane area adjacent to the former deck was <br />underlain with plastic, but it may very well have been. Staff <br />can confirm that there was indeed a la dscape area surrounding <br />the former deck. Since other former landscape areas on the <br />property are underlain with plastic, it is very likely that the <br />landscape area within the lakeshore yard wa- underlain with <br />plastic. This would confirm existing :«facover prior to <br />construction at 59%. Applicant's proposal now offers the removal <br />of 1,899 s.f. of non-structural hardcover (landscape area) for <br />530 s.f. of new structural hardcover. The former deck was at *^10 <br />s.f.; the proposed deck is 1,040 s.f. The proposal still has the <br />deck extending beyond the average lakeshore setback lire the same <br />distance the previous deck had encroached. <br />Staff has drafted 2 resolutions; one of denial and the other <br />of approval. In light of the direction of the Counc: 1 to the <br />applicant at their July 23rd meeting, the applicar;** was asked to <br />pull the new deck out of the average lakeshore area. This would <br />be consistent with previous actions by the Council in an attempt <br />tP minimize the variances sought by an applicant where such <br />excessive hardcover exists. <br />This would reduce overall hardcover by approximately 46 <br />s.f., reducing overall hard^'over to 2,609.45 s.f. or 48%. The <br />enclosed approval resolution can be amended to include non­ <br />encroachment of the average lakeshore setback line.
