A RBSOLOTIOM GRAMTIIIG <br />A VARIARCB TO <br />MDMICIPAL S0NIII6 CODE <br />SECTION 10.28» SUBDIVISION 5 (B) <br />FILE #1601 <br />WHBREAS, Weldon and Phyllic Dunn (hereinafter "the <br />applicants") are the owners of the property located at 40 Stubbs <br />Bay Road South within the City of Orono (hereinafter "City") and <br />legally described as follows: <br />That part of Government Lot 3, in Section 5, Township 117 <br />North, Range 23 West of the 5th Principal Meridian, <br />described as follows: <br />Beginning at the North quarter section corner of said <br />Section 5; thence South 4.16 chains (274.56 feet); <br />thence South 86*25 degrees East 3 chains (198.00 feet); <br />thence North 73 degrees East 2.75 chains (181.5 feet); <br />thence North 46 degrees East 2.40 chains (158.4 feet); <br />thence North 3.50 degrees East 1.90 chains (125.4 feet) <br />to the Township line; thence West 7.50 chains (495.00 <br />feet) to the place of beginning, Hennepin County, <br />Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for a <br />variance to Municipal Zoning Code Section 10.28, Subdivision 5 <br />(B) to permit the construction of a room addition to the existing <br />residence, such addition to be located 22.6' from the side lot <br />line where a 30.0' side setbac)c is normally required. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1601. <br />2. The property is located in the RR-IP Single Family Rural <br />Residential Zoning District. <br />3. Lot area is approximately 2.5 acres. <br />4. The Orono Planning Commission reviewed this application <br />on November 19, 1990 and recommended approval of the <br />proposed variance on a vote of 6-0 based upon the following <br />findings: <br />Page 1 of 4
