The covenant for the development <br />includes prohibition of living/dwelling within units on site. <br /> <br />c) The premises shall not be used for the operation of a business for retail purposes, <br />including but not limited to automobile repair. This does not prohibit minor <br />maintenance, care, or upkeep of motor vehicles, boats, trailers, or recreational <br />vehicles stored in individual units. Storage and warehousing may be permitted. <br />The applicant states this condition is met for the proposed development. If any new <br />or intensified uses are contemplated in the future, a review by City staff and <br />approval by the City Council would be required. <br /> <br />d) The management, use, and customization of the garage condos, including common <br />areas, and individual units, shall be governed by an association, which association <br />rules shall place adequate controls to ensure compliance with applicable city code. <br />A draft declaration of covenants for management of the development has been <br />submitted. This condition will be met. <br /> <br />e) The premises shall maintain adequate access to individual units and any common <br />areas or office space for emergency response and snow removal/storage. <br />The developers are proposing easements for access, drainage, and utilities <br />throughout the common spaces including the drive aisles. A knox box (a secure key <br />box that allows emergency personnel to access a building/site during an <br />emergency) will be required at the entrance gate for emergency personnel and <br />vehicle access. This condition is met. <br /> <br />f) The premises shall contain sufficient lighting and/or security measures to deter or <br />mitigate criminal activity and ensure adequate access for emergency response. <br />A lighting plan has been provided. The property is also proposed to be fenced and <br />gated. This condition is met. <br /> <br />g) Any individual unit that is connected to the city sewer and water system shall have <br />individual meters.
