<br /> <br /> <br /> Created: 2024-07-18 07:35:50 [EST] <br />(Supp. No. 21, Update 3) <br /> <br />Page 2 of 3 <br />(11) Not create a nuisance which generates smoke, noise, glare, vibration, odors, fumes, dust, <br />electrical interference, general unsightliness, or other means; There will be no nuisance smoke, <br />noise, glare, vibration, odors, fumes, dust, electrical interference or general unsightliness from <br />the proposed use. <br />(12) Not cause excessive non-residential traffic on residential streets, parking needs that cause a <br />demonstrable inconvenience to adjoining properties, traffic congestion, or unsafe access; There <br />is not planned to have any parking or congestion to impact any adjoining properties. The use is <br />expected to have significantly less traffic than the generally allowed uses in the Industrial <br />zoning districts. <br />(13) Designed to take into account the natural, scenic, and historic features of the area and to <br />minimize environmental impact; The site is being designed to have minimal impact on natural <br />or scenic areas and there are no historic areas of the land which we are aware of. <br />(14) All exterior lighting shall be so directed so as not to cast glare toward or onto the public right- <br />of-way or neighboring residential uses or districts; and The site is being designed to not cast <br />glare toward public right-of-way or neighboring residential uses or districts. <br />(15) Not detrimental to the public health, public safety, or general welfare. The proposed use is not <br />detrimental to the public health, public safety, or general welfare and is expected to have less <br />of a chance of any effect than the generally allowed uses within the Industrial zoning district. <br />(b) A conditional use permit may be granted subject to such conditions as the council may prescribe. <br />(c) A conditional use permit shall remain in effect as long as the conditions imposed by the city council <br />are observed, but nothing in this section shall prevent the city from enacting or amending official <br />controls to change the status of conditional uses. <br />(d) A certified copy of any conditional use permit shall be filed with the county recorder or registrar of <br />titles. The conditional use permit shall include the legal description of the property included. <br />(Code 1984, § 10.09(6); Ord. No. 77 3rd series, § 1, 7-12-2010) <br /> <br /> <br />Industrial District CUP: <br />(11) Garage condos, provided that: <br />a. No exterior parking or storage is permitted for a period longer than twenty-four (24) <br />hours. A parking plan must be provided to demonstrate accessibility to the site. <br />b. The premises shall not be used or customized for residential living purposes or <br />community gatherings or events. <br />c. The premises shall not be used for the operation of a business or for retail purposes, <br />including but not limited to automobile repair. This does not prohibit minor maintenance, <br />care, or upkeep of motor vehicles, boats, trailers, or recreational vehicles stored in <br />individual units. <br />d. The management, use, and customization of the garage condos, including common <br />areas, and individual units, shall be governed by an association, which association rules <br />shall place adequate controls to ensure compliance with applicable city code. <br />32
