ORDINANCB #90, SECOND SERIES . <br />AN ORDIHAHCE ADOPTING AN INTERIM MORATORIOM J <br />ON THE GRANTING OP BOILDING PERMITS, LAND SUBDIVISi- UjJjlCi// <br />REZONING APPLICATIONS, CONDITIONAL OR SPECIAL DSE PERI <br />VARIANCES, OR OTHER AOTHORITY RELATING TO THE SITING OP <br />WIRELESS TELECOMMUNICATION FACILITIES AND STRUCTURES <br />IN ALL ZONING DISTRICTS IN THE CITY OF ORONO <br />The City Council of Orono dees ordain: <br />The Municioal Code of the City of Orono is amended to add: <br />SECTION 1. Statement of Policy. The purpose of Orono Municipal <br />Code Chapter 10 is to provide for the orderly development of <br />commercial and industrial activity so as not to unreasonably <br />conflict with the primary residential and agricultural character <br />of the City. <br />SECTION 2. Interim Moratorium. To facilitate the purpose stated <br />in Section 1 the City Council^inds in necessary to a one <br />year moratorium, pursuant to Minnesota Statute Section 46..355, <br />Subdivision 4, granting of building permits, land subdivisions, <br />rezoning applications, conditional or special use permits, <br />variances, or other authority relating to the siting of wireless <br />telecommunication facilities and structures in all zoning <br />districts in the City of Orono. <br />SECTION 3. Study of Telecommunication Facilities. For tne <br />purposes of this Section the words used herein shall have the <br />following meaning: <br />1. Telecommunication - the wireless transmission, emission <br />or reception of energy or communication impulses_ by cable, <br />microwave, satellite or radio signals affecting radio, <br />telephone, telegraph or television communication or medical <br />or industrial energy transmissions. <br />2. Facility - any antenna, tower, or structure associated <br />with the transmission, emission or reception of <br />telecommunication signals. <br />SECTION 4. Duration. This ordinance may be extended by the City <br />Council for a period not to exceed an additional eighteen months <br />beyond its initial expiration, unless the City Council determines <br />it is no longer required because the requisite studies have been <br />completed and adopted and appropriate evaluation and action, <br />including any necessary revisions to the zoning code, have be <br />finalized. <br />SECTION 5. Effective Date. This ordinance shall be effective as <br />of October 8, 1990. <br />Adopted by the City Council of Orono on this 8th day of <br />October, 1990, by a vote of 4 ayes and 0 nays, <br />L.
