Section 10.02.54 of the City's Zoning Regulations defines <br />"communications systems" as Public Services and Section 10.02.75 states that ’’a principal <br />use may be either permitted or conditional". <br />Section 10.20 Subd. 3.D allows Public Services Structures as a "conditional use” in this <br />district and Subd. 4.H provides for antennas as "accessory uses" to the principal use. <br />which in this instance is a public serv ice structure. 'Fhe height of the antenna is <br />controlled by the conditional use permit under Section 10.75 Subd.2. <br />The antenna’s 150*foot self supported tower and equipment building will be placed a <br />minimum of 150 feet from all propertx ’ boundary lines and a minimum of 26 feet from <br />the abutting wetlands area, which will meet all district and wetland setback <br />requirements (see Exhibits C E and J). The tow'er will be located a minimum of 2S0 <br />feet from any other structure and a minimum of 430 feet from any residential structure <br />(see Exhibit D). <br />Conditional Use Criteria <br />Section 10.09 Subd. 6.A addresses t.he tindings th. t mus^ before a conditional <br />use permit is granted. The findings are addressed below: <br />1. That the proposed location of the conditional use is in accord with the objectives <br />of the Zoning Chapter and the purposes of the district in which the site is <br />located and Comprehensive .Municipal Plan: <br />The purpose of RR-IB one family rural residential district provides for a <br />mixture of low density residential development and limited agricultural uses. <br />Public Service Structures are a conditional use within the district un'^er Section <br />10.20 Subd. 3.D and as such are subject to conditions of approval before they <br />area permitted to develop. <br />That the proposed location of the conditional use and the proposed condition under <br />which it would be operated or maintained would not be detrimental to the public <br />heallh, safetyi or welfare, or materially injurious to properties or improvements in <br />the vicinity; <br />The antenna and equipment building will be set back a minimum of 150 feet trom <br />all property lines and 26 feet from the adjacent wetlands. Failure of this tower <br />design is extremeiy rare, but should it occur, the antenna will fall within the <br />property boundaries (see Exhibit I). It is also located 270 feet away from the <br />Vineyard of the Lake building and 430 feet from the nearest residence. <br />Cellular is a low^owcr system. The amount of energy generated from single <br />cellular phone channel is about the same that generate from a 100 watt light <br />bulb. This is less energy than is generated by the typical cordless telephone in <br />use in many homes today.
