ORONO COUNCIL MEETING HELD OCTOBER 22, 1990 <br />LMCD REPORT CONTINUED <br />not have that, they do not have an interlocking method of working <br />the scheme. They now have a scheme which they rely on for their <br />Shoreland Management which they think may change the rules, but <br />Orono, Spring Park, Deephaven, Minnetonka, v;ayzata, and Tonka Bay <br />are not going to agree v/ith the v;hole thing. The DNR is not sure <br />what to do because they are not sure they have the authority to <br />enforce it until this Plan that is only a plan is approved." <br />JoEllen said, "The DNR does have the ability to legally <br />enforce Shorel-nd Regulations." <br />Callahan replied, "That may be the case, but they were <br />relying on the LMCD to be the instrument to carry this out. They <br />have nov/ found out that the LMCD is not going to be an effective <br />method. It may be that the Plan is no longer important to the <br />DNR. " <br />JoEllen said, "I think they still cace. From the down side, <br />it may have been easier for the DNR to have the LMCD be the <br />middle person in this. I think in the long run it would have <br />easier for many of the cities to have the LMCD be the middle <br />person rather than each city having to negotiate on its own." <br />Callahan said, "The DNR is really concerned that they have <br />$45,000 which must be given away. This scheme through the LMCD <br />was a method to give it away to the cities. If that scheme falls <br />through, they won't know v/hat to do with the $45,000 and that <br />presents a bureaucratic problem." <br />JoEllen said, "$5,000 will go directly to Orono." <br />PUBLIC COMMENTS <br />Ms. Lorraine Moss, Crystal Bay Road, stated that someone is <br />in the process of constructing tall, cement posts in the wetland. <br />She said, "Rumor has it that this person intends to construct a <br />pool in the wetland area. I have lived in my house 45 years and <br />have enjoyed all of the wild life that comes and goes in the <br />wetland area. That area is a nature conservatory." <br />Mabusth explained, "This issue is scheduled to come before <br />the City shortly. V7e have sent a letter to the owner of the <br />property. It is my understanding that he will be applying for a <br />Condi* ‘ *'r*al Use Permit. Mrs. Moss is referring to pillars that <br />the ' intended to use as part of a fencing project. V7e have <br />orde> to cease work immediately." <br />Mayor Grabek advised Mrs. .Moss that the City would keep her <br />apprised of the progress involving this matter. <br />Mr. Robert Gehrman, 4300 Sixth Avenue North, stated that it <br />has come to his attention that the City of Orono v;as sued by the <br />- 21 -
