zone to yield no net increase in hardcover above the <br />existing 37.8% in that zone. Also, Planning Commission <br />noted for the record that the hardcover caused by the <br />existing detached barn and driveway, directs run-off to the <br />north and generally away from the lake. <br />4. The City Council has considered this application including <br />the findings and recommendations of the Planning Commission, <br />reports by City staff, comments by the applicant and the effect <br />of the proposed variance on the health, safety and welfare of the <br />community. <br />5. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />property in this zoning district; that granting the variance <br />would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would <br />not merely serve as a convenience to the applicant, but is <br />necessary to alleviate a demonstrable hardship or difficulty; is <br />necessary to preserve a substantial property right of the <br />applicant; and would be in keeping with the spirit and intent of <br />the Zoning Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Council hereby <br />grants a variance to the Municipal Zoning Code Section 10.23, <br />Subdivision 6 (B) to permit the construction of an entryway addition <br />located 25' from the side lot line where a 30' setback is normally <br />required, and grants a variance to Municipal Zoning Code Section <br />10.22, Subdivision 2 to allow hardcover of 37.8% in the 75-250' <br />lakeshore setback zone where only 25% hardcover is normally allowed, <br />subject to the following conditions: <br />1. Applicant is advised that hardcover on the property in the <br />0-75' and 75-250' zones may not exceed the amounts and <br />percentages as shown on the survey and table attached as Exhibit <br />B. Any future proposals to increase hardcover on the property in <br />those zones will not be allowed, but might be approved only in <br />conjunction with concurrent removals of existing hardcover, <br />yielding no net hardcover increase. <br />Page 2 of 4
