A RESOLUTION GRANTING <br />V/iRIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 2 <br />AND SECTION 10.23, SUBDIVISION 6 (B) <br />FILE #1594 <br />WHEREAS, Duane Luke (hereinafter "the applicant") is the <br />owner of the property located at 2465 North Shore Drive within the <br />City of Orono (hereinafter "City") and legally described as follows; <br />Exhibit A, attached (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.22, Subdivision 2 to <br />permit the construction of room additions to the existing residence, <br />such additions constituting hardcover in the 75-250' lakeshore setback <br />zone in excess of the 25% hardcover normally allowed, and a variance <br />to Section 10.23, Subdivision 6 (B) to allow construction of an <br />entryway addition located 25' from the side lot line where a 30' side <br />setback is normally required. <br />Minnesota : <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1594. <br />2. The property is located in the LR-IA Single Family Lakeshore <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on <br />October 15, 1990 and recommended approval of the proposed <br />variances based upon the following findings; <br />a) The orientation of the neighboring residence to the east <br />is such that the proposed 25' side setback for the entry <br />will not tend to increase the visual density of the <br />neighborhood nor will it have significant effect on the <br />neighboring property. <br />b) Although hardcover on the property already exceeds the <br />25% limitation, applicants have demonstrated that they can <br />easily remove equivalent amounts of hardcover in the 75-250' <br />Page 1 of 4
