Chair, Minnetonka; Douglas <br />Babcock, Spring Park; Marvin Bjoriin, Tonka Bay. David Cochran, <br />Greenwood, Robert Rascop, Shorewood and Eugene Strommen. <br />Executive Director, arrived after the vote on item 1. Also <br />present: Rachel Thibault, Administrative Technician and Ken <br />Schilling, Sheriff’s Water Patrol. <br />1. Code Amendment to 2.12, Subd. 7, Regarding Buoy Removal. <br />The committee received a proposed amendment to LMCD Code <br />2.12, Subd. 7 calling for removal or submergence of buoys no <br />later than December 15 of each year, providing for a later date <br />if authorized by the sheriff after receipt of an application from <br />the owner prior to December 15. Minor changes were also made to <br />Code 2.08.Subd. 3 Impoundment, changing "towing’ to "removal" and <br />deleting "without charge" from the last sentence. <br />Bjorlin moved, Babcock seconde', to recommend an amendment <br />to Code 2.12, Subd. 7 and Code 2.08. Subd. 3 per the draft dated <br />10-10-90. Motion carried unanimously. <br />2. Proposed MN Department of Natural Resource Bill for an Act <br />Regulating Personal Watercraft. <br />Thibault reviewed the DNR Bill regulating personal <br />watercraft, noting the following differences with the LMCD <br />Ordinance: <br />o DNR defines a PW as a motorboat using an inboard motor <br />powering a jet pump . . . LMCty specifies watercraft under 14’ in <br />length using a motor powering a jet pump .... <br />o DNR specifies each person on board wearing personal <br />flotation devices, which are Coast Guard approved. Type 1. II. <br />Ill or V. LMCD specifies Coast Guard approved personal <br />flotation devices but does not specify types. <br />o The DNR Bill includes sections on the age of operator and <br />permit requirement. The LMCD Ordinance adopts the Age of <br />Operator definition by reference to MN Statute 361.Ubb. <br />o The DNR does not include the sections of the LMCD <br />ordinance referring to operation within 3U0 ’ of shore. carele.ss <br />operation and prolonged operation, which were adopted <br />specifically for Lake Minnetonka. <br />o The DNR Bill has sections on prohibiting towing persons <br />without an observer, chasing wildlife and operating through <br />vegetation, not mentioned in the LMCD Code. <br />Rascop suggested distribution to the pwc review Committee <br />for comment. Deputy Ken Schilling .said the Water Patrol would <br />like to see the age minimum for LMCD’s ordinance be the same as <br />the State, which it will by the State Statute reference. <br />- continufMl
