C; <br />• <br />CITY'of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 5434 <br />9. Because the subdivision results in additional impervious area on the property, a <br />storm water management system is proposed that includes vegetated swales and <br />rain gardens to provide water quality treatment and storage for rate control. The <br />proposed storm water release off-site from this system will be less than the <br />existing condition. Easements and maintenance covenants will be required to <br />ensure the permanent viability of this system. The property will also be subject to <br />the Storm Water and Drainage Trunk Fee, established by the 2005 fee schedule as <br />$4,160 per acre for the %2 acre zone. <br />10. The proposed retaining wall to accommodate the driveway within Outlot B will <br />be in excess of 4' in height and requires an engineered design. The applicant has <br />agreed to reduce the visual impacts of this wall by using dark -colored earth -tone <br />block and ivy plantings. It would be appropriate that a covenant be established <br />requiring permanent maintenance of the ivy planting. <br />11. All proposed lots will contain suitable area meeting all established setback, <br />hardcover and lot coverage requirements to allow the construction of single <br />family residences without the need for variances. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the <br />findings noted above, the City Council of the City of Orono hereby grants Preliminary Plat <br />Approval for Loren R. Fritz for a 5 -lot plat per the Preliminary Plat survey/drawing designated as <br />Sheet C6-1 by Loucks Associates dated 2-2-06 and attached hereto as part of Exhibit B, subject <br />to the following conditions: <br />1. Lot Standards. Buildable envelopes including approved setbacks for the two <br />new back lots (Lots 3 and 4) are as shown on Sheets C2-1 and CM, the <br />Preliminary Site Plan and Preliminary Grading Plan attached as part of Exhibit B. <br />For both Lots .3 and 4, the northerly yard is the front yard, the southerly yard is <br />the rear yard, and the easterly and westerly yards are side yards. For Lot 1, by <br />definition the easterly yard is front, the westerly yard is rear, the southerly yard is <br />a side yard, and the northerly yard is a side street yard. However, because of its <br />highly visible corner lot status at the intersection of two major County roads, Lot <br />1 shall be further limited in that no principal or accessory structures shall be <br />allowed within 20 feet of the north lot line. Accessory structures may be placed <br />on all Lots according to City standards except as noted for Lot 1. <br />Page 3 of 9 <br />
